These Terms of Use govern your use of IRG-Sharing at [https://irg-wp.com/**]. Please read these Terms of Use carefully prior to using the IRG-Sharing; when you use IRG-Sharing, you agree to these Terms of Use as a condition for using the website. If you do not agree, please do not enter IRG-Sharing.
The content provided on IRG-Sharing is the intellectual property and copyrighted works of IRG, individual Members of IRG, or third-parties. You may only use the content with respect of these intellectual property rights, and in accordance with these Term of Use.
You shall assume that everything you see or read on IRG-Sharing is protected by copyright or trademark, unless otherwise indicated. No content on IRG-Sharing may be interpreted as granting you any kind of license or right of usage, copyrights or other intellectual property rights except as stated in these Terms of Use.
IRG may update, change or modify these Terms of Use, our Code-of-Conduct and our Privacy Policies from time to time, at our sole discretion. If we make material changes to the Terms of Use, IRG will publish a notice on IRG-Sharing, to provide you with the opportunity to review the changes before they become effective. Your continued use of IRG-Sharing means that you accept the updated Terms of Use.
When you visit IRG-Sharing, IRG will use any personal data you provide in accordance with our Privacy Notice to Members found here [LINK TO PRIVACY NOTICE]. Here you will also find information on your privacy rights. IRG responds to requests on disclosure, correction, addition, or deletion on personal data from the person who provided the personal data. The Privacy Notice is an integrated part of these Terms-of-Use.
IRG-Sharing is open for Members only and you will need a login using your e-mail address and a password. If your e-mail address or other information changes please, update by sending an e-mail to irg@ri.se. You may not share your password and you are responsible for all activities that occur using your password, or as a result of your access to IRG-Sharing. You agree to notify IRG immediately upon knowledge of any use of your password that you did not authorize or that is not authorized by these Terms of Use.
Members may have access to make postings on IRG-Sharing, such as, but is not limited to comments, opinions, reviews, suggestions, news, pictures, carrier information, material, including professional content, (“Contributions”). You acknowledge and agree that community forums on IRG-Sharing are public to the IRG Members and that your Contributions may be seen and used by IRG and other Members.
If you choose to make any of your personal information or other material publicly available on IRG-Sharing, you do so at your own risk.
You do not transfer ownership of your intellectual property rights simply by posting on IRG-Sharing. However, any Contributions that you transmit to IRG-Sharing, whether by email, posting, uploads or in any other format will not be treated as confidential information, and you acknowledge and accept that it may be used by IRG free of charge to be shared on IRG-Sharing and made available to the IRG Members, and you grant IRG a limited, global, royalty free, perpetual, irrevocable, non-transferable, and non-exclusive right and license, on IRG-Sharing, to host, display, publish, transmit, distribute, scan for security, create back-up copies, and make other lawful use of your Contributions.
Upon termination of your IRG Membership, IRG may continue to include your Contributions on IRG-Sharing if you do not actively request IRG to delete the Contributions. IRG has no obligation to maintain or provide any of your Contributions. For any personal data, IRG will apply to the privacy statement found in the Privacy Notice to Members.
When using IRG-Sharing, you must treat all other IRG Members with courtesy and respect and being a member of IRG, you must abide by our IRGWP Code of Conduct:
“The IRGWP expects its members, sponsors representatives and guests to adhere to high standards of professionalism and behavior. They acknowledge their responsibilities and shall give active consideration to: fellow members; students; guests; the general public; to science; and to the environment.
IRGWP contributors are expected to ensure to the best of their abilities that their scientific contributions and those of collaborators are accurate, and to encourage and participate with fellow members.
Anyone participating within IRGWP shall be treated respectfully and without exploitation, harassment or discrimination at all times.”

You may not use IRG-Sharing to discuss or conclude agreements with other IRG Members which may be anticipated or aimed to restrain the market or have other anti-competitive effects. Being a member of IRG, you must abide to the IRG Antitrust Compliance Statement of Policy and these principles equally apply for communicating at IRG-Sharing:
“Our aim is to conduct ourselves in such a way as to avoid any potential for antitrust exposure in the first instance. Full compliance with the antitrust laws is a requirement for IRG membership, and responsibility for compliance rests with each member. To comply with the antitrust laws, members should not discuss certain subjects when they are together — either at formal meetings or in informal contacts with other industry members. Topics to avoid discussing with competitors include: proprietary prices, price trends, timing of price changes, costs of common inputs, margins, terms of sale, discounts and rebates, advertised prices, promotional programs, inventory levels, production levels, capacities, new projects, and the like. Further, ISPOR and its members are prohibited from collectively:
Fixing or setting prices for selling products or services;
Allocating geographic markets or customers between or among competitors;
Bid rigging, bid rotation, or otherwise distorting the bid process;
Boycotting customers, suppliers or vendors;
Agreeing upon levels of production or output;
Conspiring to exclude competitors or customers from the market; and
Discussing specific R&D, sales or marketing plans, or any company’s confidential product, development, or production strategies.
Participants in IRG meetings have an obligation to terminate any discussion, seek legal counsel’s advice, or, if necessary, terminate any meeting if the discussion might be construed to raise antitrust risks. All IRG meetings and activities are held for the purpose of transacting the appropriate business of the IRG and to further IRG’s goals. All meetings and activities of IRG must be conducted in a manner consistent with this policy.

Please do not use IRG-Sharing in ways that may violate any laws, infringe on anyone’s rights, are offensive, or interfere with the website and its features, or are a violation of these Terms of Use.
IRG-Sharing is a community forum and shall not to be applied as an online platform-to-business for offering services.
You shall not modify, copy, republish, mirror, reverse engineer or without legal rights create derivative works based on the IRG Sharing or in any way do or authorize any third party to do any act which would misappropriate, infringe or otherwise by unlawful means invalidate any intellectual property rights in the material and contributions displayed by IRG or IRG Members on IRG-Sharing.
You can only display information on IRG-Sharing which you have a legitimate right to display and disseminate. You must ensure that your Contributions are lawful and that you have all necessary right to use it. It is at your sole responsibility and risk, to ascertain to have consents from other persons, if you post or otherwise share personal data, including pictures of other persons.
You may not upload material including sensitive data in form genetic data, biometric data for the purpose of uniquely identifying a natural person, or data concerning a natural person's sex life or sexual orientation, including such sensitive data about yourself.
Except for the exclusions provided below, you may not upload material including sensitive data in form of racial or ethnic origin, political opinions, philosophical beliefs, trade union membership or data on health conditions.

You must assure that your Contributions do not infringe third-party rights, such as but not limited to copyrighted text and images, and that your Contributions do not display fraudulent, libelous, or otherwise unlawful or tortious material, or is a violation of other persons or entities privacy or confidentiality rights, and that your Contributions do not include obscene or other harmful material.

When you upload a paper on IRG-Sharing, IRG will make information on the paper available to the general public at the open IRG website on our IRG Document Database and Compendium at https://www.irg-wp.com/irgdocs/. You give your consent to making the paper available for purchase through IRG, and free of charge for Members and IRG sponsors. You also consent to IRG may include information as your name and title into search functions, as well as other data related to the paper, such as the conference the paper was submitted to.
As an IRG Member, you will have access to membership lists and other personal data and biographies of Members of the IRG community. You have the right to view, but not download the Membership List, as well as other personal data of members shall not be downloaded or distributed, unless a specific consent is obtained by the person the data relates to. We encourage our Members to reach out to each other and share information and purposes of usage.
You may download material, not including personal data, for your own use. Papers contributed by Members may be downloaded for your personal usage, include personal data provided by the authors as included into the paper. You cannot share downloads on your own website, Linked-in, or other public sharing, without having obtained a consent by the owners of the Contribution, prior to your disposals. We encourage our Members to share information and keep the research within IRG as open as possible.
It is not possible for IRG to monitor all activities, and you acknowledge that IRG has not pre-approved or endorsed Member provided Contributions and that IRG is not responsible to screen, monitor, or otherwise control Contributions that Members provide. You acknowledge that IRG has the rights, without further justification, to reject or remove any Contributions that is published on IRG-Sharing. IRG will reject or remove content which we determine, at our sole discretion, is in conflict with applicable laws, government regulations, third-party rights, or opposes to IRG policies for compliant behavior, including as stated in these Terms of Use, as amended from time to time.
IRG may also determine to remove content if IRG receives a notice or a claim alleging that a content violates or infringes any laws or third-party rights.
If, in our sole discretion, IRG determines that you have acted inappropriately, we reserve the right to terminate your accounts, prohibit you from using the IRG-Sharing, and IRG may take appropriate legal actions.
IRG warrants that we own or otherwise have sufficient rights to grant you the rights to use IRG Sharing as stated in these Terms of Use. Subject hereto, and to the greatest extent permitted by applicable law, IRG excludes all representations and warranties relating to, and for the use of, IRG Sharing.
You are informed that content as displayed on IRG-Sharing is provided on an “AS IS” basis. Unless explicitly stated otherwise, IRG and our Members do not make any warranties of any kind, whether express, implied, statutory or otherwise, and specifically disclaims all implied warranties, including any warranties of merchantability or fitness for a specific purpose to the maximum extent permitted by applicable law.
IRG-Sharing may include links which refer you directly or indirectly to access and use a third-party website. Your use hereof and the content and services provided through such third-party websites is governed by the terms of use and other agreements posted on these third-party websites and IRG disclaims any express or implied warranty in regard to accuracy, legality, reliability or validity of any content of third party websites.
IRG shall not be liable for any damages or loss arising out of your Contributions made to IRG-Sharing, nor arising out of any IRG Member’s reliance on your Contributions. IRG does not control nor endorse any content provided by Member Contributions, and IRG shall not be liable, directly or indirectly, for any loss or damage caused to you in connection with any content posted by other Members on IRG-Sharing as Contributions or otherwise.
IRG shall not be liable for any disclosure, modification, or deletion of your data. IRG is not responsible for and assumes no liability for damages or viruses or other malicious codes or tools that may infect your systems or other property caused by your access to or use of IRG Sharing and its content. The same applies to your downloading of any text, images, materials, data, documents, photo, picture, video or other material from IRG Sharing.
Neither IRG nor others involved in creating, producing or publishing IRG-Sharing shall have any liability to you for any indirect, special, incidental, consequential or punitive loss or damages, including but not limited to loss of profit, time, goodwill, data or damage to records of data, computer failure, or the violation of your rights by any third party, or loss as a consequence of any kind of violations of intellectual property rights arising out of your or other Members’ access or use of IRG-Sharing, whether in contract, tort, or under any other theory of liability, and whether or not IRG has been advised of the possibility of such damages. The foregoing disclaimer shall not apply to the extent prohibited by applicable laws
In no event shall IRGs liability arising out of or related to these Terms of Use, whether based in contract, tort, product liability or under any other theory of liability, exceed in the aggregate the lesser of i) the total amount of membership fees paid by you to IRG during a term of 5 years or ii) one time the Swedish Price Base Amount. The foregoing limitation shall not apply to the extent prohibited by applicable laws.
Your use of IRG-Sharing as well as these Terms of Use and any disputes arising out of or related thereto shall be governed by and construed in accordance with Swedish laws without giving effect to its international referral or conflicts of laws rules. You expressly agree that any disputes arising out of or related to IRG-Sharing and these Terms of Use including its existence, validity, or termination, shall be finally settled before the Courts of Sweden. If it turns out that a particular provision in these Terms of Use is not enforceable, that will not affect any other provision.
You acknowledge that due to the nature of the IRG Sharing, any actual or threatened breach of these Terms of Use may cause immediate and/or irreparable injury to IRG and IRG Members and, therefore, IRG shall be entitled to seek injunctive relief in addition to other remedies to which it may be entitled in laws, and IRG shall have the right at any time, at its option and where legally available, to immediately commence an action or proceeding in a court of competent jurisdiction to seek a restraining order, injunction, or other equitable relief to enforce its protective rights under these Terms of Use..
As IRG Sharing is a worldwide open platform, you are not allowed, directly or indirectly, to upload and make available data or information, or other form of Contributions into IRG Sharing which are at risk of being subject to any export control laws and regulations or other sanctions by authorities such as United Nations, the European Communities or the United States.
